Acceptance of Terms
By downloading, installing, or using the Habits: Good, Bad and Friends application (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
We reserve the right to modify these Terms at any time. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
Description of Service
The App is a habit tracking application that helps users track both good and bad habits, set goals, and connect with friends for accountability and motivation. The App may include the following features:
- Habit tracking and management
- Progress visualization and statistics
- Social features including friend connections and leaderboards
- Notifications and reminders
- User profile management
User Accounts
To use certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
You agree to provide accurate and complete information when creating your account and to update your information to keep it accurate and current.
We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, false, or outdated.
User Content
The App may allow you to create, upload, or share content (“User Content”). You retain all rights to your User Content, but you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, and otherwise exploit such User Content in connection with the App.
You are solely responsible for your User Content and the consequences of posting or publishing it. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein.
You agree not to post User Content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights of any party
- Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
- Constitutes unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation
Subscription and Payments
The App offers both free and premium features. Premium features may require payment of a subscription fee.
Subscription fees are charged in advance on a monthly, annual, or lifetime basis, as specified at the time of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
You can manage your subscription and turn off auto-renewal by going to your account settings after purchase.
No refund will be provided for the unused portion of any subscription period that has already been billed.
Intellectual Property
The App and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as follows:
- Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
- You may store files that are automatically cached by your Web browser for display enhancement purposes
- If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications
Limitation of Liability
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the App
- Any conduct or content of any third party on the App
- Any content obtained from the App
- Unauthorized access, use, or alteration of your transmissions or content
Our liability is limited to the maximum extent permitted by law.
Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the App or delete your account through the App’s settings.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.
